Welcome to Inseen. These Terms of Service govern your access to and use of our website, platform, and related services. By creating an account or using our services, you agree to be bound by these terms. If you do not agree to these terms, please do not use our services.
1. Acceptance of Terms
By accessing or using Inseen's services, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms. We reserve the right to modify these terms at any time, and your continued use of the platform after such modifications constitutes acceptance of the updated terms.
2. Account Registration
To access certain features of our platform, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms or that have been inactive for an extended period.
3. Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these terms. You may not use our platform to scan websites you do not own or have authorization to scan, attempt to reverse-engineer our algorithms or proprietary technology, distribute malware or engage in any activity that disrupts our services, impersonate another person or entity, or use automated tools to access our services beyond the rate limits of your plan. We reserve the right to investigate and take appropriate action against any violations.
4. Payment Terms
Paid plans are billed in advance on a monthly or annual basis depending on your selection. All fees are non-refundable except as expressly stated in these terms or required by applicable law. We may change our pricing at any time, but price changes will not affect your current billing period. If your payment method fails, we will attempt to charge it again and may suspend your access to paid features until payment is received. You are responsible for all applicable taxes associated with your subscription.
5. Intellectual Property
All content, features, and functionality of the Inseen platform - including but not limited to text, graphics, logos, algorithms, software, and documentation - are owned by Inseen and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of your website content and data that you submit for scanning. By using our services, you grant us a limited, non-exclusive license to access and process your publicly available website data solely for the purpose of providing our services to you.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Inseen and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of our services. Our total cumulative liability for all claims related to the services shall not exceed the amount you paid to Inseen in the twelve months preceding the claim. Our services are provided on an 'as is' and 'as available' basis without warranties of any kind.
7. Termination
You may terminate your account at any time through your account settings or by contacting our support team. We may suspend or terminate your access to our services at any time if you violate these terms, if we discontinue the service, or for any other reason at our sole discretion with reasonable notice. Upon termination, your right to use the platform ceases immediately, though we may retain certain data as required by law or for legitimate business purposes. Any provisions of these terms that by their nature should survive termination will remain in effect.
8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising out of or relating to these terms or your use of our services shall be resolved exclusively in the courts located in Istanbul, Turkey. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
